HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43605 OF 2017 ORDER:

The case of the petitioner is that the 3rd respondent issued proceedings No.Rc.(M).No.283/2015, dated 25.07.2015, canceling the fair price shop authorization of the petitioner to Shop No.19, Kanakaveedu Village, Nandavaram Mandal, Kurnool District, and against the same the petitioner filed appeal before the 2nd respondent along with stay application. But, no orders are passed, till date. Without deciding the appeal of the petitioner, the respondents passed impugned notification dated 11.12.2017 inviting applications from the eligible candidates for appointment as Fair Price Shop dealer to the subject fair price shop (FP Shop No.19). Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner.

Heard learned Assistant Government Pleader for Civil Supplies who submits that appeal is still pending. In view of the aforesaid facts and circumstances, the 2nd respondent is directed to dispose of the appeal filed by the petitioner, within a period of four weeks from the date of receipt of a copy of this order. Till appeal is disposed of, there shall be stay of finalization of the results for selection of Fair Price Shop

dealer. The respondent authorities may proceed further depending upon the results in the appeal.

Accordingly, the writ petition is disposed of. No order as to costs.
