It is the case of the petitioners that they purchased agricultural land to an extent of Acs.1.06 cents in Sy.No.16/2A situated at Yelamanchi village and Mandal, Visakhapatnam District through registered sale deed No.606/1985 dated 15.04.1985 from one Acharya Veera Bhadra Rao; that before registration of the said document, the petitioners and their father cultivated the said land from 12.01.1941 till the date of registration i.e., 15.04.1985. They have been issued pattadar pass books and title deeds. While so, the 4th respondent issued Eviction Notice under Section 7 of the A.P.Land Encroachment Act on 22.12.2018 and petitioner submitted explanation 24.12.2018, but without passing any orders on the explanation of the petitioners, the respondents are trying to evict the petitioners from the subject property. Aggrieved by the same, present Writ Petition is filed. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for respondents 1 to 4 and Sri Nimmagadda Venkateshwarlu, learned Standing Counsel for the 5th respondent.

In view of above facts and circumstances, without expressing any opinion on the merits of the case, the competent authority-4th respondent is directed to consider the explanation of the petitioners, after giving an opportunity of hearing, pass final orders in accordance with law. Till passing of final orders, status quo regarding possession shall be maintained.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 28-12-2018 kvs
