THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39911 of 2017 ORDER:
The petitioner and the fifth respondent are plaintiff and defendant respectively in O.S.No.50 of 2017 in the Court of the learned Junior Civil Judge, Tungathurthy. On 02.11.2017, the trial Court granted ad interim injunction and the same is subsisting. Now, the grievance is that the fourth respondent at the instance of the fifth respondent is interfering in the civil dispute.
The learned Assistant Government Pleader (Home) on instructions submits that when a complaint is received from the fifth respondent, the fourth respondent has merely called the petitioner on phone and is not interfering in the civil dispute. The submission of the fourth respondent is placed on record and accepted. It is made clear that this Court has not considered the merits of the issue pending in O.S.No.50 of 2017 in the Court of the learned Junior Civil Judge, Tungathurthy. Except placing on record the submission of the fourth respondent, no other aspect is considered.
The Writ Petition is disposed of accordingly. No order as to costs.
As a sequel, Miscellaneous Petitions, if any, pending, shall stand disposed of as infructuous.
