HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO I.A.Nos.2 and 3 of 2018 in/and Criminal Petition No.14099 of 2018 ORDER :
The petitioner is the accused in S.C.No.890 of 2016 on the file of the learned I Addl. District Judge-cum-Metropolitan Sessions Judge, Cyberabad, at L.B.Nagar, Ranga Reddy district, Telangana State, outcome of Cr.No.163 of 2016, dt.22.06.2016 of Vikarabad Police Station for the offences punishable u/sec.376 IPC and u/sec.3(A) of Protection of Children from Sexual Offences Act (for short, 'the POCSO Act') on the report of the 2nd respondent, the father of the victim girlby name Gurupani. The defacto-complainant along with his daughter-the so called victim girl since major and the accused persons along with their counsel present before the Court.
It is the say of the defacto-complainant and his daughter that the complaint was given under certain circumstances and later her marriage was performed with Manne Dinesh s/o Mallesh, Ismathpuram, The present case is coming in the way of her prospective marital life that is not even within the knowledge of her husband and it may break their marital tie is their apprehension they also stated that they assured to the accused to withdraw the present crime in the settlement before the elders outside the Court took place way back in March, 2018 including on financial aspects and it is in her better interest, they are permitted to compound the offences, otherwise allegations are grave and not prone for compounding even exercising inherent power but to subserve ends of justice only.
In the result, the I.A.Nos.2 and 3 of 2018 are allowed. Consequently, the Criminal Petition is also allowed quashing the proceedings against the petitioner/accused in S.C.No.890 of 2016 on the file of the learned I Addl. District Judge-cum-Metropolitan Sessions Judge, Cybeabad, at L.B.Nagar, Ranga Reddy district, Telangana State, outcome of Cr.No.163 of 2016 of Vikarabad Police
