HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT APPEAL No.1749 of 2018 JUDGMENT: (per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) We have heard the learned counsel for the appellant. 2.

The appellant and the fourth respondent are a couple. There was matrimonial discard that led to certain earlier proceedings. We see from the impugned order of the learned Single Judge that a complaint made by the fourth respondent and others was investigated and a final report has been filed in that case. There was also a quashment proceeding. We need not delve into all those matters because in the instant case, the learned Single Judge was not persuaded to hold that a further investigation or a fresh investigation should be ordered at the instance of the appellant on the allegations that he has made. Obviously, this was done for the sake of finality obtained through the final report that has been filed in the case which is referred to in the impugned order. Obviously, the appellant's rights, if any, for action for or against that final report will remain open.

3.

We do not see that there is any ground for us to interfere with the impugned order in this intra-Court appeal. Therefore,

HCJ & ARR, J W.A.No.1749 of 2018 leaving all remedies open to the appellant in appropriate jurisdictions other than through the Writ Court, this Writ Appeal is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. There shall be no order as to costs. ___________________________________ THOTTATHIL B. RADHAKRISHNAN, CJ Date: 25.01.2019 ________________________ A. RAJASHEKER REDDY, J kvni
