ORDER : (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for issue of Habeas Corpus directing respondent No.4 to produce Mr. K. Raja Gobal, s/o. Krishnan, aged about 75 years (for short "the alleged detenu") before this Court.
The Sub-Inspector of Police, Tirumala II Town Police Station, Chittoor District, has filed a counter affidavit wherein he has inter alia stated that none of the Police Stations, viz., Tirumala II Town Police Station, Tirumala I Town Police Station, Central Crime Police Station and Traffic Police Station have taken the alleged detenu into custody and that, therefore, they are not concerned with the missing of the alleged detenu. He has further stated that the Tirumala II Town Police have contacted over the two Mobile numbers given at paper No.
11 of the papers filed along with the writ petition in order to ascertain whether they have approached either I Town Police Station or II Town Police Station, Tirumala, for lodging complaint and that they have stated that they have not approached either of the Police Stations, that the Tirumala II Town Police have requested them to lodge a complaint for registering FIR for tracing the alleged detenu and that so far the police have not received any response from the other end.
respondent No.4 in the counter affidavit, his client seeks to withdraw the writ petition with liberty to the petitioner to give a report to the police on the missing of the alleged detenu and to trace him out.
Accordingly, the writ petition is disposed of as withdrawn with liberty to the petitioner in terms of the prayer made above. No order as to costs.
