Sri Vankani Mallesham, learned counsel for the petitioner, would, of course, comes out with Civil Miscellaneous Appeal is the proper remedy, though, initially would contend that a Revision under Article 227 of the Constitution of India is always maintainable, and then seeks permission to withdraw the present Civil Revision Petition with liberty to approach the concerned Court for appropriate remedy under the provisions of the Civil Procedure Code. Granting such permission, the present Civil Revision Petition is dismissed as withdrawn.
As a sequel thereto, miscellaneous petitions, if any, pending in the present Revision shall stand closed.
