HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE P.KESHAVA RAO Writ Petition No.47746 of 2018 Order: (per V.Ramasubramanian, J.) The petitioner has come up with the above writ petition challenging an order of penalty.

2. Heard Mr. Bhaskar Reddy Vemireddy, learned counsel for the petitioner. Mr. T.Vinod Kumar, learned Special Standing Counsel, takes notice for the respondents.

3. The petitioner came up with W.P.No.33985 of 2018, challenging the order of assessment. That writ petition was allowed on 19-12-2018. The matter was remanded back to the authority.

4. Once the order of assessment is set aside, the order of penalty should follow suit. Therefore, this writ petition is allowed and the impugned order set aside. If the fresh assessment proceedings result in any liability, it will be open to the Assessing Officer to initiate fresh proceedings for penalty. Pending applications, if any, shall stand closed. No costs.
