HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 42592 of 2017 Order:

The petitioner was appointed as a Driver in Madhira Depot in Khammam Region on 01.01.1998 and his services were regularized in the same year. He was transferred to Krishna Region by proceedings dated 23.12.2004 and he is now working in the third respondent Depot. He states that the first respondent issued a Circular on 04.06.2005 extending one increment as special grade on completion of 12 years of service and the said benefit was not extended to him even though he completed 12 years of service by 2010. He states that he submitted a representation on 20.10.2015 and, when the same was not disposed of, he filed the present Writ Petition.

Learned Standing Counsel for the respondents submits that there is no acknowledgment on the representation and it is not known whether the said representation was in fact sent or not. However, since the grievance relates to the sanction of special grade increment after completion of 12 years of service, the petitioner is given liberty to send a Xerox copy of the representation alleged to have been sent on 20.10.2015 afresh for consideration of the second respondent and on receipt of the same the respondents 2 and 3 shall consider the said representation and pass appropriate orders in accordance with law within a period of three months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
