The Hon'ble Sri Justice A.Rajasheker Reddy Writ Petition No.41231 of 2017 Order:
This Writ Petition is filed for the following substantive relief:
"to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the order, dated 30-05-2017 passed by the respondent No.4 suspending the Fair Price Shop Authorisation issued in petitioner favour for the Fair Price Shop No.8, Diddekunta Simhadripuram Mandal, Y.S.R District as arbitrary, illegal, colorable exercise of power, contrary to the provisions of the Andhra Pradesh State Public Distribution System (Control) Order, 2008, well settled legal principles and vitiated by efflux of time as has been held by this Hon'ble Court in the case of NI.VENKATA RAMAIAH.V. 10.:NT COLLECTOR (CS), ANANTHAPUR reported in 2014 (2) ALD 492 apart from being violative of the fundamental rights guaranteed to petitioner under Articles 14, 19 & 21 of the Constitution of India and consequently set-aside the same."
At the hearing, Mr.V.R.Reddy Kovvuri, learned Counsel for the petitioner, submitted that in pursuance of the impugned order of suspension, final order has already been passed vide Ref.No.186/17, dated 06-12-2017; that the same was questioned in WP.No.41948 of 2017; that this Court granted interim suspension of the same; and that
ARR, J W.P.No.41231 of 2017 Dt: 11-12-2017 therefore, the cause in this Writ Petition does not survive for adjudication.
The aforesaid submission of the learned Counsel for the petitioner is placed on record and the Writ Petition is, accordingly, dismissed as infructuous.
As a sequel, Miscellaneous Petitions, pending if any, stand disposed of as infrucutous.
