HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.41869 of 2017 ORDER:

On 11.12.2017 and 18.12.2017, at request of Assistant Government Pleader, the writ petition has been adjourned. The Assistant Government Pleader renews her request for further time to get instructions from respondent namely on the time the respondent needs for disposing of appeal dated 06.12.2016 filed by petitioner herein.

I have perused the appeal dated 06.12.2016 and also the acknowledgment of even date. The 1st respondent by now ought to have taken up the matter, c alled for reports and issued orders as are warranted in this behalf. In a case like this, the continued inaction is likely to cause hardship to the patients, who visit the clinic of complainant. Hence, as the prayer is only for disposing of the appeal filed by petitioner, the request for adjournment is refused.

The petitioner is given liberty to re-submit copy of appeal dated 06.12.2016 to the 1st respondent by enclosing a copy of this order within four weeks from today.

The 1st respondent considers disposing of the appeal in accordance with law, after affording opportunity to the person

against whom the complaint is made, within two months from re-submission.

The writ petition is disposed of accordingly. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
