Thotapalli Kistaswamy, v. The State Of Telangana,
THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.48079 of 2018 ORDER: (Per the Hon'ble the Chief Justice Sri Thottathil B.Radhakrishnan) This Writ Petition is filed by some of the inhabitants of the Gram Panchayat of Gollapalli Village. They plead that the proposal to bifurcate that Gram Panchayat as of now been carried out is adverse to the interest of the local inhabitants including certain matters connected to religious functions in a place of worship.
2.
Learned Government Pleader points out that similar issues arose for decision in W.P (PIL).No.171 of 2018 and this Court noticed that the matter is entirely within the legislative domain and not even for the Government to take a final decision.
3.
Hearing the learned counsel for the petitioner and the learned Government Pleader, we are satisfied that the same procedure adopted in W.P (PIL).No.171 of 2018 can be followed in the case in hand.
4.
Accordingly, there will be a direction that if the petitioners have made an appropriate representation or if they make such a representation with relevant facts and materials to the satisfaction of the competent authority, the authority will bestow due attention to that representation and consider it in accordance with law. If the Government sees any ex facie
injustice in the situation now obtained, that may be appropriately brought to the notice of the competent legislature. The Writ Petition is ordered accordingly.
The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. _______________________________________ THOTTATHIL B. RADHAKRISHNAN, CJ _____________________________ A.RAJASHEKER REDDY, J 05.02.2019 vs
