HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION NO.40812 OF 2017 ORDER:
Heard Sri P.Narasimhulu for petitioner, the Assistant Government Pleader (Home) and the Assistant Government Pleader (Revenue).
The petitioner is the plaintiff in O.S.No.204 of 2017 in the Court of Junior Civil Judge, Penukonda. The learned trial Judge in I.A.No.486 of 2017 granted ad-interim injunction in favour of petitioner. While the matter stood thus, the 3rd respondent after receiving the representations of petitioner and the 5th respondent, addressed letter Rc.No.196/ 2017/ b dated 09.08.2017 to 4th respondent. Challenging the letter, dated 09.08.2017, the present writ petition is filed.
This Court prima facie is of the view that the petitioner since has already moved the Civil Court for reliefs is not precluded from bringing the communication dated 09.08.2017 to the notice of learned trial Judge and obtain orders as are necessary in the circumstances of the case. The petitioner is given liberty accordingly.
With the above observation, the writ petition is dismissed. No order as to costs.
