THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.14058 OF 2018 ORDER:
This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused, for grant of bail in Crime No.06/ACB-ADB/2018 of ACB, Adilabad Range, registered for the offence punishable under Section 7(a)(b) of Prevention of Corruption (Amendment) Act, 2018. 2.
Heard the learned counsel for the petitioner/accused, the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.
Learned counsel for the petitioner/accused would contend that the petitioner is not maintaining good health and ultimately, prayed to allow the petition.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused and contended that earlier bail application of the petitioner was dismissed by this Court vide order 18.12.2018 in Crl.P.No.13064 of 2018 and by dismissal of the same, statements of witnesses under Section 164 Cr.P.C. were already recorded and ultimately, prayed to dismiss the petition. 5.
There are specific and grave allegations against the petitioner that he took Rs.1.00 lakh on two different occasions. The conversation relating to demand and acceptance of the amount was recorded with the help of sky gadget. Hence, detailed order was passed dismissing the earlier bail application of the petitioner assigning reasons. Not maintaining good health by the petitioner is
not a ground to allow the petition. There are no merits to allow the petition.

Hence, the Criminal Petition is dismissed.
Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
