THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.47959 of 2018 ORDER:

This writ petition is filed seeking to declare the action of the 2nd respondent in trying to demolish the petitioner's plot No.195South Part to an extent of 166.5 sq. yards in Sy.Nos.445, 446, 447, 448/1 and 448/2 situated at Sriram Nagar Colony, Pasumamula Village, Hayathnagar Mandal, Ranga Reddy District, without following due process of law, as illegal and arbitrary.

Petitioner asserts that he purchased the aforesaid house plot from his vendor, by name, D. Anitha, on 20.09.2018 vide document No.9780/2018. He further asserts that his vendor had purchased the same from one Ranga Raju Raghu Mohan Raju vide registered sale deed, dated 26.09.2012. He also asserts that his vendor obtained permission for construction of house and accordingly, she constructed the house. After purchase, the petitioner applied for Building Regulating Scheme by paying penalty fee and LRS on 02.03.2018 and the same are pending. However, the 2nd respondent and his staff came to the house of petitioner on 22.12.2018 and trying to demolish the part of the building without issuing any notice to him.

Except making the aforesaid allegations in the writ petition, no material is placed before this Court. In those circumstances, the writ petition is disposed of, giving liberty to the petitioner to

CKR, J W.P.No.47959 of 2018 make appropriate application to the 2nd respondent, and on receipt of the same, the 2nd respondent shall consider and pass appropriate orders in accordance with law. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition, shall stand closed.
