THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No.40541 of 2017 ORDER: (Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan) The qualification prescribed, for appointment as School Assistant Mathematics, is that the candidate must possess a graduate/post graduate degree in mathematics from a University recognised by the UGC with 50% marks, and should have passed the bachelor of education course with mathematics as a methodology from any institution recognised by the NCTE. In the absence of any express stipulation to the contrary, a graduate in engineering, with mathematics as one of the subjects, may claim to fall within the category of graduate/post graduate in mathematics.

However, the additional requirement is for the candidate to pass his bachelor degree in education course with mathematics as a methodology subject. The petitioner did his B.Ed from Osmania University, and none of the subjects which he studied in the B.Ed course have any relation to mathematics. The petitioner does not, therefore, fulfil the qualifications prescribed for appointment as a School Assistant in Mathematics. The submission that the petitioner fulfils the minimum academic and professional qualifications stipulated in the NCTE regulations is only to be noted to be rejected, since the qualification prescribed therein is a graduate/post graduate from a recognised University with 50% marks, and a bachelor of education degree from an NCTE recognised institution.

Accepting the submission of the Learned Counsel for the petitioner would mean that, even a post graduate in history, with history as the methodology subject in B.Ed, would be eligible to be

appointed as a School Assistant in Mathematics, and teach higher secondary school students, mathematics as a subject. We find it difficult to accept such a submission. We are satisfied that the respondents cannot be faulted for rejecting the petitioner's application, to appear for the teacher recruitment test for appointment as a School Assistant in Mathematics. The Writ Petition fails and is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall stand closed. No costs.
