THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.41588 OF 2017 ORDER:
Heard learned counsel for the petitioner and the learned standing counsel for the second respondent.
The petitioner states that he is presently working as Senior Assistant in the Office of Tahsildar, Kadem Mandal of Nirmal District. The next higher post is Deputy Tahsildar/Naib Tahsildar and in order to get promotion to the said post, the petitioner has to pass certain tests like (a) Revenue Test Part I, II and III; (b) Civil Judicial Test Part II; (c) Criminal Judicial Test; (d) Indian Evidence Act; and (e) Accounts Test for Subordinate Officers Part I. While so, the second respondent issued a Notification No.19 of 2016 to conduct departmental test and the petitioner appeared for the said examination. He got 38 marks and declared 'failed'. After publishing the Key, he noticed that answers to four questions were not given correctly and if they were given correct, he would have got 42 marks.
In that connection, he submitted a representation on 14.09.2017 and when the same was not considered, he filed the present writ petition challenging the action of the respondents in publishing wrong key and declaring the result of the petitioner on the basis of the said wrong answers in respect of question Nos.8, 18, 19 and 95 for Booklet Series 'B' relating to Indian Evidence Act in the examinations conducted pursuant to the Notification No.19 of 2016.
When the matter is taken up for hearing, the learned standing counsel for the second respondent agreed for the disposal of the writ petition by a direction to the second respondent to consider the representation dated 14.09.2017 of the petitioner in accordance with law. In view of the same, the writ petition is disposed of directing the second respondent to consider the representation of the petitioner, dated
14.09.2017 and pass appropriate orders thereon within a period of three weeks from the date of receipt of copy of this order. Consequently, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
