O R D E R

Challenge in this writ petition is to the order dated 20.01.2017 passed by the Tahsildar, Madgulapally Mandal, Nalgonda District, and the consequential order dated 22.12.2018 based thereon. The present writ petition was filed in December, 2018.

The order dated 20.01.2017 is appealable under Rule 29 of the Telangana Water, Land and Trees Rules, 2004. Without taking recourse to the efficacious alternative remedy provided to him, the petitioner cannot come before this Court by way of a writ petition. All the more so, when there are disputed questions of fact in the context of whether or not the bore well of the petitioner was seized pursuant to the order dated 20.01.2017.

The writ petition is accordingly disposed of permitting the petitioner to prefer an appeal within one week from the date of receipt of a copy of this order. In the event such an appeal is filed, the appellate authority shall consider the appeal on its own merits and in accordance with law expeditiously.
