HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.47703 of 2018 ORDER:

It is the case of the petitioner that he is owner and possessor of land to an extent of 0.56 cents in Sy.No.104/14, Vemavaram Village, Vijayawada Rural, Krishna District and his name is also entered in the ROR records notifying the subject land as patta land. While so, the 4th respondent issued notice in Rc.No.B/234/2017, dated 21.03.2017 stating that if the land is not brought under cultivation within a period of three years from the date of assignment, it is liable to be resumed or be vested with the Government and the petitioner also gave explanation on 30.03.2017 to the same. But without considering the explanation of the petitioner, the respondents are trying to dispossess the petitioner from the subject land.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents. In view of above facts and circumstances, without expressing any opinion on the merits of the case, the competent authority-4th respondent is directed to consider the explanation of the petitioner, after giving an opportunity of hearing, pass appropriate orders in accordance with law. Till passing of final orders, status quo regarding possession shall be maintained.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 28-12-2018 kvs
