Venkataiah Petitioner (Accused No.1 in Cr.No. 398/2017 of Keesara P.S., Rachakonda Commissionerate, Medchal Malkajgiri Dist) AND The State of Telangana, rep by its Public Prosecutor, High Court at Hyderabad. Respondent Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to direct the Station House Officer, Keesara Police Station to release the petitioner on bail in the event of his arrest in connection with Cr.No. 398 of 2017 of Keesara Police Station, Rachakonda Commissionerate, Medchal Malkajgiri District. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri C.Damodar Reddy, Advocate for the Petitioner and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:

" This Criminal Petition is filed by the petitioner/A-1 under section 438 of Cr.P.C., seeking to enlarge him on bail in anticipation of his arrest in Crime No. 398 of 2017 of Keesara Police Station, Rachakonda Commissionerate, Medchal, Malkajgiri district registered for the offences punishable under section 406, 420, 465, 468, 471 and 506 of IPC.

2. Heard the learned counsel for the petitioner/A-1 and the learned Public Prosecutor for the respondent/State.

3. According to the case of prosecution, this petitioner is only the attestor of the document. The allegation against this petitioner and A-3 is that they colluded with each other, fabricated and forged the document. Prima facie case, this petitioner is only an attestor of the document. Hence I deem it a fit case to grant anticipatory bail to the petitioner/A-1. Hence, this Criminal Petition is allowed.

4. Accordingly, the petitioner/A-1 shall be released on bail in anticipation of his arrest in Crime No. 398 of 2017 of Keesara Police Station, Rachakonda Commissionerate, Medchal, Malkajgiri district, on his executing a personal bond of Rs. 20,000=00 (Rs. Twenty Thousand only) with two sureties for the like sum each to the satisfaction of Station House Officer, Keesara Police Station, Rachakonda Commissionerate, Medchal, Malkajgiri district.

6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed."
