THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.42388 of 2017 ORDER:

The petitioner was initially appointed as Temporary Section Writer on 11.09.1971 and continued as such till 28.12.1975. His services were regularized on 04.12.1971 by proceedings dated 06.12.1975. Subsequently he was appointed as Lower Division Clerk on 29.12.1975 and retired as such on attaining the age of superannuation on 31.05.2001. His pension was also settled and he was aware that his period of service from 11.08.1969 to 28.12.1975 was not taken into consideration at the time of settling the pension. It appears that he submitted representations to the respondents, the details of which are not furnished in the affidavit. Now he filed the present Writ Petition seeking a direction to the respondents to take the temporary service rendered by him from 11.08.1969 to 28.12.1975 into account for calculating the pension.

It is clear from the above facts that the petitioner retired from service on 31.05.2001 and the present Writ Petition is filed after 16 years. If the petitioner had any grievance, he should have approached the competent Court as and when the cause of action arose or within one year thereafter. The petitioner filed the present Writ Petition after 16 years and this cannot be entertained by this Court, which is already overburdened.

The Writ Petition is, accordingly, dismissed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
