The petitioner was appointed as a Tracer in the Roads and Buildings Department initially on 16.06.1983. His services were regularized and he was promoted to the post of Draughtsman (Civil) Grade III on 04.05.1992. Thereafter, he was promoted as Assistant Engineer on 17.01.2007. He passed the required departmental tests and he is fully eligible for promotion to the post of Deputy Executive Engineer. While so, the seniority list in the cadre of Draughtsman Grade III was issued on 01.11.1998, where the name of the petitioner was shown at serial No.12.

Though the present Writ Petition is filed challenging placement of the fourth respondent, when this Court was not inclined to grant any interim order, learned Counsel for the petitioner sought disposal of the Writ Petition directing consideration of the representation of the petitioner dated 23.08.2017 with regard to the grievance of seniority of the petitioner over the fourth respondent. In the circumstances, this Writ Petition is disposed of directing the second respondent to consider the representation of the petitioner dated 23.08.2017 in accordance with law and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
