HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43308 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents in trying to lay road in the petitioner's land in RS.No.357/4 to an extent of Ac.0.60 1⁄2 cents in China Agiripalli Village, Krishna District, without following due process of law, as illegal and arbitrary and for a consequential direction to the respondents not to interfere with the possession and enjoyment of petitioner's land. Heard learned counsel for the petitioner.

Sri G.Seshadri, learned Standing Counsel for the 4th respondent on instructions submits that Gram Panchayat is not laying any road through the petitioner's land; and that if at all Gram Panchayat requires any land for public purpose, they will follow due process of law.

Recording the aforesaid submission of the learned Standing Counsel, the writ petition is disposed of directing the 4th respondents Gram Panchayat not to lay road through the aforesaid petitioner's land, without following due process of law.

With the above direction, the writ petition is disposed of. No order as to costs.
