HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.A. No. 1922 of 2017 JUDGMENT:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ appeal is preferred against the Common Order dated 12.09.2016 in W.P.No. 11216 of 2015 passed by learned Single Judge of this Court, whereby the writ petition filed by the appellant herein, has been dismissed.
The learned counsel for the appellant submits that against the impugned Common Order dated 12.09.2016 in W.P.No. 10066 of 2015, the petitioners therein filed W.A.No. 1918 of 2017, and the same has been allowed by this Court vide judgment dated 17.07.2017, thus, similar order may be passed in the present writ appeal also because the issue involved in W.A.No. 1918 of 2017 and in the present appeal is one and the same.
The learned Government Pleader for School Education appearing on behalf of the respondents, does not dispute the same and submits that the same judgment as passed in W.A.No. 1918 of 2017 may be passed in the present writ appeal also.
In view of the above submissions of the learned counsel for both the parties, the writ appeal is allowed setting aside the Common Order dated 12.09.2016 passed by the learned
SKK,J & AKS,J WA_1922_2017 Single Judge in W.P.No. 11216 of 2015 insofar as it relates to the appellant herein is concerned. Accordingly, the official respondents are directed to consider the case of the appellant for appointment to the post of T.G.T. as per his merit without insisting on the study of medium of instruction in English at any two levels in his academic career. No order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
