THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.14101 OF 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused, for grant of bail in Crime No.1022 of 2018 of Mailardevpally Police Station, Cyberabad Commissionerate, registered for the offence punishable under Section 307 of IPC.

Heard the learned counsel for the petitioner/accused, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is brought to the notice of this Court that the petitioner/accused, without approaching the Court of Session under Section 438 Cr.P.C., filed this application before this Court. Under these circumstances, it is not appropriate to deal with this application, on merits, by this Court. There are no special or exceptional circumstances to consider this application by this Court. The petitioner/accused is at liberty to file an application before the Court of Session, under Section 438 Cr.P.C., if he chooses to do so.

With the above observation, the Criminal Petition is disposed of.
