HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.14103 of 2018 ORDER :

Heard the learned counsel for the petitioners/ A.1 to A.3 in Cr.No.127 of 2018 of Nandivada Police Station, Krishna District, registered for the offences punishable u/ sec.324 and 506 read with 34 IPC and u/ sec.3(1)® and (s) of the Scheduled Caste and Scheduled Tribes(Prevention of Atrocities) Act,(for short, 'the Act') and also heard the learned Public Prosecutor representing the 1st respondent-State before ordering notice to the 2nd respondent/ Complainant and perused the grounds urged in the quash petition and the contents of the First Information Report. Undisputedly none of the offences are with the punishment of above 7 years, if at all any arrest of the petitioners/ A.1 to A.3 is required, the police shall strictly follow Section 41-A of CrPC, and also the guidelines in Arnesh Kumar Vs. State of Bihar1. All available defences are left open to the petitioners. Having regard to the above, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
