THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI Writ Petition No.48185 OF 2018 ORDER:

This Writ Petition is filed challenging the order issued by the 3rd respondent vide Rc.No.2377/B1/2018-56 dated 02.08.2018 transferring and posting the petitioner to ZPHS, Nednoor, Kandukur Mandal, Rangareddy District in the left over vacancy which is 100 KM away from her previous place of posting and without allowing her to participate in the counselling as illegal and arbitrary.

The learned counsel for the petitioner submitted that the petitioner was transferred to ZPHS, Nednoor, Kandukur Mandal, Rangareddy District vide proceedings dated 02.08.2018. The grievance of the petitioner is that the petitioner was not allowed to participate in the counselling and in the left over vacancy the case of the petitioner was considered vide proceedings dated 02.08.2018 and the petitioner was transferred to ZPHS, Nednoor, Kandukur Mandal, Rangareddy District, which is 100 KM away from her previous place of posting. The grievance of the petitioner is that there are many existing vacancies in and around ZPHS, Kapra, Kapra Mandal, Medchal Malkajgiri district (Rangareddy) and to that effect the petitioner has preferred an appeal to the respondents on 04.08.2018. The petitioner further contends that the appellate authority has not passed any orders on the appeal preferred by the petitioner. The learned counsel for the petitioner contended that the respondents may be directed to pass appropriate orders on the appeal preferred by the petitioner.

The learned Government Pleader for Services I submits that appropriate orders would be passed by the appellate authority on the appeal preferred by the petitioner in accordance with rules. This Court, having considered the rival contentions made by the learned counsel for the parties, is of the considered view that this Writ Petition can be disposed of directing the appellate authority to pass appropriate orders on the appeal preferred by the petitioner in accordance with Rues, within a period of four weeks from the date of receipt of a copy of this order. The learned counsel for the petitioner is also permitted to file additional grounds in the appeal.

With the above observations, this Writ Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed. ------------------------------------------------------- JUSTICE ABHINAND KUMAR SHAVILI Dt: 02.01.2019 Kvsn
