THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.12776 OF 2017 ORDER:

This Criminal Petition is filed under Section 439 (1) (b) Cr.P.C. seeking to relax the condition imposed against the petitioners-A.2 to A.5, A.7 and A.8 in crime No.128 of 2017 of R.P.S., Warangal, directing them to report before the Station House Officer, R.P.S., Warangal twice a week i.e. on every Sunday and Wednesday, between 9.00 AM and 11.00 AM till further orders, in the order dated 13.11.2017 in Crl.M.P. No.811 of 2017 on the file of the Special Sessions Judge for NDPS Cases-cum-I Additional Sessions Judge, Warangal while granting bail to the petitioners-A.2 to A.5, A.7 and A.8.

Heard the learned counsel for the petitionersA.2 to A.5, A.7 and A.8, the learned Additional Public Prosecutor and perused the material on record. 3.

Learned counsel for the petitioners- A.2 to A.5, A.7 and A.8 would submit that the petitioners- A.2 to A.5, A.7 and A.8 are residents of Rayagada District of Orissa State and the condition sought to be relaxed causes much hardship to them to come to Warangal and stay there for two days every week to attend before the S.H.O. on Sunday and Wednesday, and hence, he prays to relax the condition. 4.

Having regard to circumstances narrated by the learned counsel for the petitioners, the condition imposed against the petitioners-A.2 to A.5, A.7 and A.8 in crime No.128 of 2017 of R.P.S., Warangal, directing them to report before the Station House Officer, R.P.S., Warangal

twice a week i.e. on every Sunday and Wednesday, between 9.00 AM and 11.00 AM till further orders, in the order dated 13.11.2017 in Crl.M.P. No.811 of 2017 on the file of the Special Sessions Judge for NDPS Cases-cum-I Additional Sessions Judge, Warangal is modified, and the petitioners-A.2 to A.5, A.7 and A.8 shall report before the S.H.O., R.P.S., Warangal on every first Sunday and third Sunday between 11.00 AM and 12.00 Noon till filing of the charge sheet.

The Criminal Petition is, accordingly, disposed of.
