Heard the learned counsel for the petitioners/ A.1 and A.2 in Cr.No.767 of 2018 of the Station House Officer, Air Port Police Station, Visakhapatnam, registered for the offences punishable u/ sec.498-A, 342 and 323 read with 34 IPC and Sections 3, 4 and 6 of the Dowry Prohibition Act, on the report of the 2nd respondentdefacto-complainant and also heard the learned Public Prosecutor representing the 1st respondent-State before ordering notice to the 2nd respondent/ Complainant and perused the grounds urged in the quash petition and the contents of the First Information Report. Undisputedly none of the offences are with the punishment of above 7 years, if at all any arrest of the petitioners/ A.1 and A.2 is required, the police shall strictly follow Section 41-A of CrPC, and also the guidelines in Arnesh Kumar Vs. State of Bihar1. All available defences are left open to the petitioners. Having regard to the above, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
