HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.48166 of 2018 ORDER:
This writ petition is filed seeking a Writ of Mandamus declaring the action of respondents 1 and 2 in not continuing the services of the petitioners as District Resource Persons of Secunderabad, Nizamabad and Karimnagar Districts of Telangana State even though they are working since 2008 from the inception of S.V.Bhakthi Channel, as illegal, arbitrary and violative of principles of natural justice and sought consequential directions to the respondents to continue the petitioners as District Resource Persons in view of their appointment orders dated 14.06.2013 and 24.01.2013 and grant all consequential benefits. Heard Sri Kowturu Pavan Kumar, counsel for petitioners and the Standing Counsel appearing for respondents.
It has been contended by the petitioners that they are all Journalists by profession and they were appointed by S.V.Bhakthi Channel during 2008 on contract basis and their tenure of contract has been extended from time to time. The petitioners further submit that the 2nd respondent had issued appointment orders in favour of the petitioners during January and June 2013 as District Resource Persons on honorarium basis. The petitioners have been discharging their duties to the best satisfaction of their superiors and everyone concerned. However, during January 2017, the services of petitioners were discontinued without assigning any reasons. Thereafter, the petitioners have been continuously making representations to the respondents to continue them as District Resource Persons, but the respondents are not considering the said representations.
Counsel for petitioners submit that the petitioners have submitted the last representation on 18.12.2017 and contend that appropriate orders be passed in the writ petition directing the respondents to consider the representation dated 18.12.2017 and pass appropriate orders in accordance with law and further direct the respondents to re-engage the petitioners as District Resource Persons.
The learned Standing Counsel appearing for respondents contend that appropriate orders will be passed on the representation submitted by the petitioners in accordance with law.
In view of the submission made by the learned Standing Counsel for respondents, this Court is of the considered view that the writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioners on 18.12.2017 and pass appropriate orders in accordance with law within six weeks from the date of receipt of a copy of this order.
With these observations, the writ petition is disposed of. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed. ______________________________ ABHINAND KUMAR SHAVILI, J 2nd January, 2019 ajr
