SMT JUSTICE T.RAJANI CRIMINAL PETITION No.12884 OF 2017 ORDER:

This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused No.3 in Sessions Case No.115 of 2017 on the file of I Additional District and Sessions Judge, East Godavari district at Rajamahendravaram.

The offences alleged are under Section 8(c) R/w.20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the Act').

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

The case of the prosecution is that 100 K.Gs. of ganza is seized from accused Nos.1 to 4, jointly. Even if seizure of ganza is divided among each of the accused, it falls beyond the commercial quantity. Petitioner's counsel, except contending that the petitioner is a woman and she has been in jail since 24.03.2017, does not make any submission, which would entitle her for bail, by overcoming the hurdles of Section 37 of the Act. 5.

In view of the above, this Court considers that this is not a fit case for grant bail to the petitioner. Accordingly, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
