This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, for grant of anticipatory bail in the event of his arrest in Crime No.233 of 2017 on the file of the Venkatagiri Police Station, SPSR Nellore District, registered for the offence punishable under Section 420 of I.P.C.

Heard the learned counsel for the petitioner/ accused, learned Additional Public Prosecutor representing the respondent-State and perused the record.

Earlier anticipatory bail application of the petitioner/ accused was dismissed by this Court by order, dated 28.11.2017, passed in Crl.P.No.10849 of 2017. There is no change of circumstances. There is a prima facie case against the petitioner/ accused. He is not entitled for bail under Section 438 of Cr.P.C. 4 .

The Criminal Petition is, accordingly, dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
