HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION Nos.48125, 48129, 48130 and 48131 of 2018 and 1394 of 2019 COMMON ORDER:
The grievance of the petitioners in this batch of cases is with regard to the action of Bachupally Gram Panchayat, Bachupally Village and Mandal, Medchal-Malkajgiri District, in threatening to demolish the renovations undertaken by them in relation to their villas in Hill County, Bachupally Village and Mandal, MedchalMalkajgiri District. Perusal of the record reflects that the show cause notices issued by Bachupally Gram Panchayat did not set out in detail the violations, if any, committed by each of the petitioners in relation to their approved sanctioned plans. Without putting the petitioners on specific notice as to how they deviated from the sanctioned plans obtained by them, it is not open to Bachupally Gram Panchayat to threaten demolition.
The Writ Petitions are accordingly disposed of setting aside the impugned show cause notices and leaving it open to Bachupally Gram Panchayat, Bachupally Village and Mandal, Medchal-Malkajgiri District, to issue fresh show cause notices, if warranted, in each of the petitioners' cases setting out in detail the alleged specific violations committed by them in relation to their approved sanctioned plans. Bachupally Gram Panchayat shall afford them a reasonable opportunity to put forth their objections and thereafter
pass reasoned orders thereon. It would then be open to it to take further action, if warranted, in accordance with the due procedure.
