Babu @ Anand Babu Petitioner (Accused in Cr.No.225/2017 of Amravathi P.S., Guntur Dist) AND The State of A.P., SHO, Amaravathi P.S., Guntur District, rep. by its Public Prosecutor, at High Court of Judicature, Hyderabad, for the State of Andhra Pradesh, Hyderabad. Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in connection with the case in Cr.No. 225 of 2017 on the file of the SHO, Amaravathi P.S., Guntur District numbered as PRC 21 of 2017 on the file of the Hon'ble II Addl. Junior Civil Judge, Sattenapalli, Guntur District, which was registered for the alleged offences under Sections 376 r/w. 511 and 452, 354, 324, 506 of IPC.
The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri G.L.Nageswar Rao, Advocate for the Petitioner and of the Addl.
" Petitioner/accused seeks regular bail. He is alleged to have committed offences punishable under Sections 376 read with 511 and 452, 354, 324 and 506 of IPC in Cr.No. 225 of 2017 of Amaravathi Police Station, Guntur District. The accusation is that on the mid night of 23rd August, 2017 while the defacto complainant, who is an aged lady of 65 years was sleeping in her verandah, the accused allegedly criminally trespassed into her house and misbehaved with her and tried to commit rape on her and threatened her with dire consequences.
Denying the accusation, bail is sought for on the main argument that the petitioner has been in custody since 3rd October, 2017 and that investigation is completed and charge sheet is also filed.
Learned Additional Public Prosecutor admitted the factum of filing of charge sheet and numbering of PRC.No. 21 of 2017 on the file of II Additional Junior Civil Judge, Sathenapalli, Guntur District. Having regard to the above facts, this Criminal Petition is allowed. The petitioner/accused shall be enlarged on bail on his executing a personal bond for Rs. 30,000/- (Rupees thirty thousand only) with two sureties each for a like sum to the satisfaction of the II Additional Junior Civil Judge Sathenapalli, Guntur District.
