HON'BLE THE CHI EF JUSTI CE SRI THOTTATHI L B. RADHAKRI SHNAN TRANSFER C.M.P. No.264 of 2017 ORDER:

This is an application seeking transfer of F.C.O.P.No.134 of 2016, pending before the Judge, Family Court, Karimnagar, to the Additional District Courts at Tenali and/or the Judge, Family Court, Guntur District.

Learned counsel for the petitioner-wife points out that the substance of the petition filed by the respondent-husband for divorce shows that no cause of action can be built in such a way that the Family Court at Karimnagar would get jurisdiction. 3.

Learned counsel for the respondent-husband, however, makes a reference to paragraph 3 of the petition filed for divorce to demonstrate that the alleged desertion, as pleaded, was from the respondent's house in Karimnagar.

Deliberating on the aforesaid issue and the distance between Karimnagar and Tenali, the learned counsel for the parties have agreed to the suggestion that the F.C.O.P. be transferred from Karimnagar Court to Suryapet Court.

In the result, the Transfer Petition is allowed transferring F.C.O.P.No.134 of 2016 from the Court of the Judge, Family Court, Karimnagar, to the competent Court at Suryapet. Pending miscellaneous petitions, if any, shall also stand dismissed.
