Heard before admission.

It is one of the contentions that the dispute is purely and predominantly civil in nature and prone to relief for specific performance of the contract for sale. However, it is a matter to be investigated and premature to come to a conclusion before the report once there are ingredients to some extent.

Having regard to the above, the Criminal Petition is disposed of with a direction that while continuing the investigation not to arrest pending investigation but for if at all to secure the presence of the petitioners when required and if failed to appear, Police can follow Section 41-A Cr.P.C. irrespective of this order of not to arrest. All defences and remedies are left open on final report being filed. Miscellaneous petitions pending, if any, shall stand closed. ____________________________ Dr. B.
