Petitioner is aggrieved by the letter dated 21.12.2018, where under provisional assessment of liability was fixed at 3,08,844/- on the allegation of pilferage of electricity by suppressing the actual consumption and subject to determination of civil liability under Section 154(5) of Electricity Act, 2003.

This Court cannot express any opinion on the allegation leveled against petitioner or on making provisional assessment at this stage. 3.
Learned counsel for petitioner informs the Court that on 24.12.2018, petitioner paid 1,54,422/-, which is 50% of the amount determined, and therefore power supply connection ought to have been restored, but the same is not restored. 4.
Having regard to the said submission and subject to determination of civil liability, the respondents are directed to restore the power supply connection, if the amount is already paid by the petitioner as stated by petitioner and photocopy of the receipt dated 24.12.2018 is enclosed at page no.15 of material book of the writ petition. Respondents shall not insist for payment of balance amount until final orders are passed under Section 154(5) of the Electricity Act, 2003. Such restoration and continuation of power supply shall be subject to petitioner complying with all other conditions of power supply.
