THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.44017 OF 2017 Dated:27.12.2017 K. Venkatapathi Raju, S/o. Buchiramachandra Raju, aged 71 years, Occ: Agriculturist, rep., by his General Power of Attorney holder, U. Krishna, S/o. Late Narayana, aged 40 years, Occ: Business, R/o.H.No.1-103/3, Gundlapochampally Village, Medchal Mandal, Ranga Reddy District .. Petitioner And The State of Telangana, rep., by its Principal Secretary, Department of Home, Secretariat, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.44017 OF 2017 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Home appearing for the respondents. 2.
Apprehending that the Station House Officer, Shamirpet Police Station, Cyberabad, Ranga Reddy District, the 2nd respondent, is involving in civil disputes and coercing the petitioner to part with valuable private property, this Writ Petition is filed.
3.
According to petitioner, there is inter se dispute regarding property and civil suits are pending. Petitioner and the opponent have filed complaints and investigation is in progress. 4.
Learned counsel for the petitioner submits that the petitioner is not coming in the way of conducting investigation and his grievance is only confined to the threat exerted by the 2nd respondent and interfering in civil disputes. 5.
Except making vague allegations, no specific instances are pointed out. It is also not in dispute that three crimes are registered and the Police are required to investigate into the said crimes. In the guise of alleging involvement in civil disputes, petitioner cannot stall the Police investigating the crimes. 6.
According to the written instructions furnished to learned Government Pleader for Home by the Station House Officer, even though notices were issued under Section 41-A (1) Cr.P.C.,
petitioner is not cooperating with the Police for completion of investigation.
7.
Having regard to these facts, it cannot be, prima facie, held that the 2nd respondent is interfering in civil disputes. However, it is needless to observe that in civil disputes, the Police have no role. Thus, the 2nd respondent has to confine himself to the nature of complaints lodged by the respective parties and to conduct investigation into the said complaints. Petitioner shall cooperate with the Police in conducting investigation into the crimes.
8.
With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
