THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.12336 OF 2017 ORDER:

The present petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code'), is filed seeking to quash the First Information Report in Crime No.538 of 2017 of Gachibowli Police Station, Cyberabad.

The petitioner is the sole accused in the aforesaid crime. He alleged to have committed the offence punishable under Section 420 IPC.

Sri C. Hari Preeth, learned counsel for the petitioner, would urge to give a direction to the Investigating Officer to follow the procedure under Section 41A of the Code.

The request of the learned counsel for petitioner appears to be reasonable, in view of the statutory mandate itself. Therefore, acceding to the said request, the Investigating Officer is directed to follow the procedure inlaid by the provisions of Section 41A of the Code and also the guidelines laid down by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1.

With the above direction, the Criminal Petition is disposed of at the admission stage itself.

Miscellaneous Petitions, if any, pending in this petition, stand closed.
