THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11869 OF 2017 ORDER:

Heard learned counsel for the petitioners/A.1 and A.3, learned Additional Public Prosecutor for the respondent State and perused the record.

This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioners/A.1 and A.3 in Crime No.55 of 2017 of Butchayyapeta Police Station, Visakhapatnam, for the offence punishable under Section 20(b)(c)(1) read with Section 8(c) of NDPS Act.

As per the material placed on record, 200 kgs of ganja has been transported in a car bearing No.TS 11 EB 0369 by the petitioners/A.1 to A.3. It is a commercial quantity. It cannot be said that the petitioners have no conspicuous possession of ganja, which was seized under a cover of panchanama following the procedure established under law. It is brought to the notice of this Court that charge-sheet was filed and the Sessions Case number was given.

In view of the quantity of ganja and the nature of allegations, it is not a fit case to allow the petition.
