This civil revision petition under Article 227 of the Constitution is sought to be maintained by the fourth defendant in O.S.No.1238 of 2017 on the file of the learned XVI Additional District and Sessions Judge, Ranga Reddy District at Malkajgiri aggrieved by the ad interim ex parte status quo order dated 08.11.2017 passed in I.A.No.934 of 2017 filed in the said suit.

Sri Ganesh Bhujanga Rao Vadduri, learned counsel for the petitioner, would fairly state that his client is yet to file her response to the I.A. in question. He would further state that his client is being prevented from making constructions by virtue of the status quo order passed by the Court below.

However, perusal of the order under challenge reflects that the status quo was granted by the trial Court only in respect of alienations of the suit property to third parties. The status quo is therefore not absolute in terms and is only limited to alienations being made to third parties in so far as the suit property is concerned. In the light of the Order 39 Rule 3-A CPC, it is for the petitioner to file her counter in I.A.No.934 of 2017 in O.S.No.1238 of 2017 and seek its disposal in terms of the statutory provision.

Leaving it open to the petitioner to do so, the civil revision petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
