HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.42996 OF 2017 ORDER:

The grievance of the petitioners is that they acquired the subject lands through their mother by name Boraka Venkamma W/o.Veerappa. The mother of the petitioners died intestate leaving behind the petitioners and they have got title and interest over the subject property. Respondent No.3 issued preliminary notification to acquire the lands of the petitioners for the purpose of construction of Polavaram Irrigation Project and his mother's name was noted therein as pattadar in respect of subject lands. The 3rd respondent issued Form VII DD notification dated 25-04-2017 and confirmed the rights of the petitioners as beneficiary i.e. B.Venkamma already died as intestate and they are in possession of the subject lands. But respondents 5 and 6 filed objections dated 25-05-2017 stating that they purchased the subject lands from the mother of the petitioners without filing any documents to substantiate their claim. Though award enquiry is completed, the Land Acquisition officer has not passed any award. Aggrieved by the same, the present writ petition is filed.

Since it is stated that the petitioners have made claims in respect of subject lands and respondents 5 and 6 also claimed them, it is for respondent No.3 to consider the said aspect and pass award.

In view of the same, respondent No.3 is directed to pass award after considering the claim of the petitioners as well as

respondents 5 and 6 and take action accordingly in accordance with law within a period of two months from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 19-12-2017 Nvl
