THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.42810 of 2017 ORDER:

The petitioner was appointed as Field Assistant in Kitumala Gram Panchayat, Chintapalli Mandal, Visakhapatnam District, under Mahatma Gandhi National Rural Employment Guarantee Scheme in the year 2011. While so, she was kept under suspension by order dated 29.09.2017 temporarily from the post of Field Assistant and the enquiry is pending. When no orders are passed till today, the present Writ Petition is filed challenging the said order of suspension.

It appears that the petitioner was kept under suspension pursuant to the irregularities noticed in the 8th round social audit conducted in Chintapalli Mandal. When disciplinary proceedings were initiated in the month of September, 2017, the enquiry proceedings should have been concluded by now. Since the proceedings are pending, this Court is not inclined to entertain the Writ Petition by interfering with the order of suspension, but directs the third respondent to complete the enquiry initiated against the petitioner, as expeditiously as possible, but not later than six weeks from the date of receipt of a

copy of this order by giving due opportunity to the petitioner.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 18.12.2017 Note: Issue C.C in one week.
