THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.43615 of 2017 ORDER:

In this writ petition, the challenge is to the proceedings in Roc.No.168/T/2017, dated 16.12.2017, of the Collector and District Magistrate, Vikarabad, whereby while suspending the agreement made with the petitioner, the petitioner was called upon to show cause, within a period of ten (10) days from the date of receipt of the said order, as to why the agreement shall not be terminated. Aggrieved thereby, the petitioner is before this court. I have heard the submissions of Sri A.Kranti Kumar Reddy, learned counsel for the petitioner, and of learned Government Pleader for Animal Husbandry appearing for the respondents. I have perused the material available on record. Learned counsel for the petitioner, at the time of hearing, submits that the reports, dated 08.12.

2017, of Members of CPTs and MPTs submitted to the District Collector, Vikarabad, are not supplied to the petitioner and that if copies of said reports are supplied to the petitioner and liberty is given to submit an explanation to the orders of the District Collector, as sought for in the orders, the petitioner would comply with the said directions. He would further submit that in the event the petitioner submits explanation to the orders of the District Collector, the District Collector may be directed to dispose of the same, in accordance with the procedure established by law within the time frame and that would meet the ends of justice.

Having regard to the facts and submissions of the case, the impugned order is set aside and the Writ Petition is accordingly disposed of with the following directions: The second respondentDistrict Collector is directed to arrange to serve on the petitioner, the copies of reports of Members of CPTs and MPTs to enable the petitioner to furnish his explanation as sought for in the impugned orders. On receiving the copies of such reports, the petitioner shall, within two weeks, submit explanation as sought for in the impugned orders; on petitioner submitting such explanation, the District Collector-second respondent herein shall consider and dispose of the same within two weeks thereafter, in accordance with the procedure established by law, and communicate the decision taken thereon to the petitioner within a week thereafter.
