THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11670 OF 2017 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), is filed by the petitioner/accused for grant of anticipatory bail in the event of his arrest in connection with Crime No.413 of 2017 of Subedari Police Station, Warangal Commissionerate, registered for the offences punishable under Sections 354D and 506 I.P.C. 2.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor representing the respondent-State and perused the record. 3.

Learned counsel for the petitioner would submit that the petitioner is an innocent person and falsely implicated in this case. There are no ingredients of Sections 354D and 506 I.P.C. and ultimately, prayed to allow the application.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused.

The report, dated 12.10.2017, lodged with the police by the de facto complainant reveals that the petitioner/accused developed acquaintance with the de facto complainant about two years back. Thereafter, he informed her that he was in love with her. The de facto complainant stated to him that she has no love on him. Then the petitioner/accused abused her and started harassing her and asking her to love her. He is also making telephone calls, in spite of the objections made by the de facto complainant and her parents. Having kept quite for some time, when the de facto

complainant getting marriage alliances, the petitioner/accused alleged to have threatened her to do away with her life and also forcing her to marry him.

The de facto complainant apprehends danger to her life from the hands of the petitioner. The allegations are grave. The matter requires investigation. The release of the petitioner/accused on bail would hinder the investigation. There is possibility of winning over the witnesses and causing disappearance of the electronic evidence. Under these circumstances, the petitioner/accused is not entitled to bail under Section 438 Cr.P.C.

Hence, the Criminal Petition is dismissed.
