HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.P.No.11692 OF 2017 ORDER:

This criminal petition is filed under Section 482 of Cr.P.C to direct the Additional Sessions Judge, Chodavaram, Visakhapatnam District to dispose of S.C.No.58 of 2010 as expeditiously as possible, fixing time.

The only grievance before this Court is that the Session's Case is of seven years old i.e. pre 2012 and on account of undue delay, the petitioner being de facto complainant facing lot of inconvenience.

Learned counsel for the petitioner also drew the attention of this Court to the judgment of the Apex Court in Hussain and another v Union of India (Crl.A.No.509 of 2017, judgment dated 09.03.2017).

Undisputedly, the Session's case is of the year 2010. The Apex Court directed all the High Courts to clear pendency and in view of issuance of circular orders dated 18.09.2017 to dispose of pre 2012 matters and the High Court is also monitoring the disposal of every officer. Therefore, the trial Court is bound to dispose of the matter as expeditiously as possible at least within the time limit fixed by the Apex Court. Hence, in view of the directions issued by the Apex Court and circular orders issued by this Court from time to time, no direction need be given. However,the trial Court is directed to dispose of the Session's case at least within the time frame

fixed by the Apex Court and the time fixed in the circular issued by this Court referred supra.

With the above direction, the criminal petition is disposed of at the stage of admission.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
