HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.A. No. 1959 of 2017 JUDGMENT:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ appeal is preferred against the interim order dated 10.03.2017 in W.P.M.P.No. 9787 of 2017 in W.P.No. 7935 of 2017 passed by learned Single Judge of this Court. The learned Single Judge, while dismissing the petition, granted liberty to the appellant to apply for additional monetary benefit and observed that filing such application and receiving the amount would be without prejudice to his claim in the writ petition.

In pursuance of the impugned order, the appellant admittedly filed a representation and the respondents considered the same and paid an amount of Rs.4,60,362/ - to the appellant as additional monetary benefit. The fact remains that as the issue raised in the writ petition is still pending adjudication, we are not inclined to pass any order in the present appeal.

Hence, the writ appeal is dismissed. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
