Petition filed under Sections 438 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to grant anticipatory bail to the petitioner in the event of his arrest in connection with Crime No. 94 of 2017 on the file of WPS, Khammam.
The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Vuppalapati Sreenivasa Rao, Advocate for the Petitioners and of Public Prosecutor(TS) on behalf of Respondent-State, the Court made the following ORDER :- "This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioners, who are accused Nos.1 to 3, in Crime No.94 of 2017 on the file of the Station House Officer, Women Police Station, Khammam. The offences alleged are under Sections 498-A of I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961.
2. Heard the learned counsel for the petitioners, learned Public Prosecutor appearing for the respondent-State, and perused the record.
3. As per the case of the prosecution, the petitioners have harassed the de-facto complainant, who is the wife of the 1st petitioner. Learned counsel for the petitioners submits that, in fact, there is no legal marriage between the de-facto complainant and the 1st petitioner and that the de-facto complainant cheated and married the 1st petitioner. He further submits that the de-facto complainant is drawing pension by showing herself as a widow of another person.
4. Hence, considering the above, this Court opines that this is a fit case for grant of anticipatory bail to the petitioners. Accordingly, the Criminal Petition is allowed. The petitioners/accused Nos.1 to 3 are directed to surrender before the Station House Officer, Women Police Station, Khammam, within 15 days from the date of this order. On such surrender, the petitioners/accused Nos.1 to 3 shall be released on bail on each of their executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioners/accused Nos.1 to 3 are directed to appear before the said Station House Officer once in a week i.e., on every Monday in between 10:00 a.m. and 12:00 noon, until further orders or till filing of charge sheet whichever is earlier.
