THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.12128 OF 2017 ORDER:

This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner-accused for the offences alleged under Sections 409 and 420 IPC. 2.

Heard learned counsel for the petitioneraccused, learned Additional Public Prosecutor representing the State and perused the record.

In the course of submissions, it is brought to the notice of this Court that the petitioner-accused was arrested on 14.12.2017 and also remanded to judicial custody.

Under these circumstances, the cause does not survive in this application.

Accordingly, the Criminal Petition is dismissed as infructuous.
