.....Respondent/ Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the petition filed herein, the High Court may be pleased to release the petitioner on bail, pending investigation, enquiry and trial into Crime No.283 of 2017 of Tiruchanur Police Station, Tirupati, Chittoor District. The petition coming on for hearing, upon perusing the Petition filed in support thereof and upon hearing the arguments of Sri Suresh Kumar Reddy Kalava, Advocate for the petitioner and of the learned Public Prosecutor (AP) for the Respondent-State, the Court made the following ORDER:
"This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused in Crime No.283 of 2017 on the file of Tiruchanur Police Station, Tirupati, Chittoor district.

The offences alleged are under Sections 376 and 366 of I.P.C. 3.
Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.
The statement of the victim, recorded by the Police, is furnished by the Public Prosecutor; wherein she stated that the accused made a proposal for marrying her and her father did not agree for the same and several times the accused telephoned to her and pressurized her to marry him but she expressed that she is not willing for the same. Subsequently, the accused came to her house and when there was nobody in her house, took her into the bathroom and had sexual relationship with her and he also asked her not to reveal the same to anyone and later when she became pregnant, the accused gave some tablets for aborting the pregnancy. As such there was an abortion and later also the accused used to telephone her and tell her that he took her photographs and he would upload the same in the facebook and youtube.

However, learned counsel for the petitioner submits that the petitioner was arrested on 07.10.2017 and has been in jail since then, the investigation is almost completed and that the statements of the material witnesses were also recorded.

Considering the above submission and also taking into consideration of the age of the accused i.e., 29 years and that the petitioner is a private employee and the entire investigation is completed, this Criminal Petition is allowed.

Accordingly, the petitioner/accused is directed to be enlarged on bail, on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the V Additional Judicial First Class Magistrate, Tirupati, Chittoor district. Accordingly, with the above observation, the Criminal Petition is allowed. As a sequel, the miscellaneous applications, if any pending, shall stand closed."
